OF JANUARY 2004

        ORDINANCE TO VACATE THE MORATORIUM ESTABLISHED BY ORDINANCE C.S. NO. 03-0788 ON ISSUANCE OF BUILDING PERMITS FOR CONSTRUCTION OR PLACEMENT OF BUILDING STRUCTURES ON PROPERTY WITHIN A PORTION OF TAMMANY HILLS SUBDIVISION (WARD 3, DISTRICT 5)

    WHEREAS, pending action to correct drainage conditions in a portion of Tammany Hills Subdivision, on November 6, 2003 the Parish Council adopted Ordinance C.S. No. 03-0788 establishing a ninety (90) day moratorium on the issuance of building permits for construction or placement of building structures in said subdivision; and

    WHEREAS, corrective measures have been completed and the moratorium is no longer necessary and should be vacated in accordance with Section 5-056.00 of the Parish Code of Ordinances.

    THE PARISH OF ST. TAMMANY HEREBY ORDAINS that the Parish Council vacates the moratorium established by Ordinance C.S. No. 03-0788 on the issuance of building permits for construction or placement of building structures on property within a portion of Tammany Hills Subdivision, Ward 3, District 5, described as follows to-wit:
    
    A portion of Tammany Hills Subdivision bounded by Jefferson Avenue, Monroe Avenue, 1st Street and 10th Street, to include opened and unopened rights-of-way therein and all property abutting both sides of said rights-of-way; all as more fully described on the plat attached hereto.

    REPEAL: All Ordinances or parts of Ordinances in conflict herewith are hereby repealed.

    SEVERABILITY: If any provision of this Ordinance shall be held to be invalid, such invalidity shall not affect other provisions herein which can be given effect without the invalid provision and to this end the provisions of this Ordinance are hereby declared to be severable.

    EFFECTIVE DATE: This Ordinance shall become effective immediately upon final adoption.
