ST. TAMMANY PARISH COUNCIL

RESOLUTION

RESOLUTION COUNCIL SERIES NO. C-1017

        RESOLUTION OF INTENTION TO AMEND THE BOUNDARIES OF GRAVITY DRAINAGE DISTRICT NO. 4 AND GRAVITY DRAINAGE DISTRICT NO. 5, AND DIRECTING THE COUNCIL CHAIRMAN TO GIVE DUE NOTICE THEREOF.
    
    WHEREAS, by Ordinance No. 90-1231, dated February 15, 1990, the St. Tammany Parish Police Jury created Gravity Drainage District No. 4.

    WHEREAS, in addition, the St. Tammany Parish Police Jury adopted Ordinance No. 93- 1792, dated August 19, 1993, creating Gravity Drainage District No. 5.

    WHEREAS, the boundaries of St. Tammany Parish Gravity Drainage District No. 5 include a portion of the Little Ponchitalawa Creek Basin; and

    WHEREAS, in order for Gravity Drainage District No. 5 to provide proper watershed management in the district, the district boundaries need to be amended to include all of the Little Ponchitalawa Creek Basin which originates within the district boundaries; and

    WHEREAS, the Parish Council now desires to amend the boundaries of Gravity Drainage District No. 4 and Gravity Drainage District No. 5 as described below.

    THE PARISH OF ST. TAMMANY HEREBY RESOLVES that in compliance with the provisions of St. Tammany Home Rule Charter Section 8-06 and Louisiana Revised Statute 33:1415 and other constitutional and statutory authority supplemental thereto, it is the intention of the Parish Council to amend the boundaries of Gravity Drainage District No. 4 to exclude the following area, to-wit:

     Commence at the intersection of Highway 59 and Interstate 12, the point of beginning; thence follow Highway 59 south to its intersection with Dove Park Road; thence follow Dove Park Road west, north, and west to its intersection with Westwood Drive; thence follow Westwood Drive south to its intersection with Fairway Drive; thence follow Fairway Drive west to its intersection with U.S. Highway 190; thence follow U.S. Highway 190 north to its intersection with the Ponchitalawa Creek; thence follow the meanderings of the Ponchitalawa Creek northeasterly to its intersection with Interstate 12; thence follow Interstate 12 southeast to its intersection with Highway 59, also the point of beginning.

    The Parish Council shall meet in open and public session at its regular meeting place, the Council Chambers, 21490 Koop Drive, Mandeville, Louisiana, on the 4TH day of March, 2004, at 6:00 p.m., for the purpose of hearing any and all objections to the amendments of the boundaries of the aforesaid Gravity Drainage Districts, and, after disposing of all objections, the Parish Council shall, if it determines to do so, adopt the necessary ordinance providing for same.

    BE IT FURTHER RESOLVED that the Chairman of the Parish Council is hereby ordered and directed to issue a Notice of Intention of the Parish Council to amend the boundaries of the said Districts, which notice shall embrace substantially all things set forth in this resolution, shall be substantially in the form attached as Exhibit “A” hereto, and shall be published in accordance with the provisions of law.

EXHIBIT “A”

NOTICE OF INTENTION

    Pursuant to the provisions of a resolution adopted by the Council of the Parish of St. Tammany, State of Louisiana, on February 5, 2004, NOTICE IS HEREBY GIVEN of the intention of said Parish Council to amend the boundaries of Gravity Drainage District No. 4, St. Tammany Parish, Louisiana, to exclude the following described area from its boundaries and to include said area within Gravity Drainage District No. 5, to-wit:

     Commence at the intersection of Highway 59 and Interstate 12, the point of beginning; thence follow Highway 59 south to its intersection with Dove Park Road; thence follow Dove Park Road west, north, and west to its intersection with Westwood Drive; thence follow Westwood Drive south to its intersection with Fairway Drive; thence follow Fairway Drive west to its intersection with U.S. Highway 190; thence follow U.S. Highway 190 north to its intersection with the Ponchitalawa Creek; thence follow the meanderings of the Ponchitalawa Creek northeasterly to its intersection with Interstate 12; thence follow Interstate 12 southeast to its intersection with Highway 59, also the point of beginning.

    NOTICE IS HEREBY FURTHER GIVEN that the Council of the Parish of St. Tammany, State of Louisiana, will meet in open and public session at its regular meeting place, the Parish Council Chambers, 21490 Koop Drive, Mandeville, Louisiana, on Thursday, March 4, 2004 at 6:00 p.m., and will at that time hear any and all objections to amending the boundaries of said Gravity Drainage Districts, and, after disposing of all objections, if it determines to do so, will adopt an ordinance ratifying and approving the amending of the boundaries of Gravity Drainage District No. 4 and Gravity Drainage District No. 5.
