        ORDINANCE TO AMEND PARISH CODE OF ORDINANCES, CHAPTER 16, ARTICLES 1 AND XI, PROVIDING FOR AN AMENDMENT TO THE BOUNDARIES OF RECREATION DISTRICT NO. 1 AND RECREATION DISTRICT NO. 10, AND DIRECTING THE COUNCIL CHAIRMAN TO GIVE DUE NOTICE THEREOF.
            
    WHEREAS, the boundaries of St. Tammany Parish Recreation District No. 1 include within it all of Ward 4, the City of Mandeville and River Oaks Subdivision; and

    WHEREAS, the boundaries of St. Tammany Parish Recreation District No. 10 include within it all of Ward 3, excluding River Oaks Subdivision, and including the City of Covington; and

    WHEREAS, the Parish Council now desires to amend the boundaries of Recreation District No. 1 and Recreation District No. 10 with regard to an area presently comprising voting Precincts 307 and 309, as more fully described below; and

    WHEREAS, at a regular meeting, this Parish Council, acting under authority of Louisiana Revised Statute 33:4562 and St. Tammany Parish Home Rule Charter Section 8-06, adopted a resolution giving notice of intention to amend the boundaries of Recreation District No. 1 and Recreation District No. 10, describing the area proposed to be altered and all matters required by law, and provided that this Parish Council would meet in open and public session at 6:00 p.m. on February 5, 2004, at its regular meeting place, for the purpose of hearing any and all objections to the amendment of the boundaries of the Districts, and, after disposing of all objections, if it so determines, adopt an ordinance providing for same; and

    WHEREAS, said notice of intention has been duly published once a week for three (3) consecutive weeks in the official journal of this Parish; and

    WHEREAS, this Parish Council did assemble at such place and time and all objections were heard to the proposed amendment of the boundaries of the Districts, and duly disposed.

    THE PARISH OF ST. TAMMANY HEREBY ORDAINS, pursuant to the provisions of Louisiana Revised Statute 33:4562 and St. Tammany Parish Home Rule Charter Section 8-06, to amend the boundaries of Recreation District No. 10 to exclude that area of Ward 3 presently comprising voting Precincts 307 and 309, and to amend the boundaries of Recreation District No. 1 to include that area of Ward 3 presently comprising voting Precincts 307 and 309, and as more fully described as follows:

    Commence at the intersection of Highway 190 and Interstate 12, also the point of beginning; thence follow Highway 190 north to its intersection with 2nd Avenue; thence follow 2nd Avenue east and northeast to its intersection with Harrison Avenue; thence follow Harrison Avenue east to its intersection with Fuchsia Street; thence follow Fuchsia Street south to its intersection with Washington Avenue; thence follow Washington Avenue west to its intersection with 11th Street; thence follow 11th Street south to its intersection with Lincoln Street; thence follow Lincoln Street east to its intersection with North Street; thence follow North Street northeast to its intersection with 11th Avenue; thence follow 11th Avenue southeast to its intersection with Soell

    Drive; thence follow Soell Drive southwest to its intersection with Parker Drive; thence follow Parker Drive southeast to its intersection with Highway 59; thence follow Highway 59 south to its intersection with Ponchitalawa Creek; thence follow the meanderings of Ponchitalawa Creek generally southwest to Highway 190; thence follow Highway 190 north to Interstate 12, also the point of beginning.

    BE IT FURTHER ORDAINED that due notice of the amendment of boundaries of the Districts, attached hereto as Exhibit “A”, be published in accordance with law and the Chairman of the Parish Council be and she is hereby instructed and ordered to issue said notice and to cause publication thereof in the official journal of St. Tammany Parish.

    REPEAL: All Ordinances or parts of Ordinances in conflict herewith are hereby repealed.

    SEVERABILITY: If any provision of this Ordinance shall be held to be invalid, such invalidity shall not affect other provisions herein which can be given effect without the invalid provision and to this end the provisions of this Ordinance are hereby declared to be severable.

    EFFECTIVE DATE: This Ordinance shall become effective immediately upon final adoption.
