        ORDINANCE TO EXTEND FOR AN ADDITIONAL SIX (6) MONTHS THE MORATORIUM ON THE RECEIPT OF SUBMISSIONS BY THE PARISH ZONING AND PLANNING COMMISSIONS FOR REZONING OF PROPERTY AND/OR THE ISSUANCE OF BUILDING PERMITS FOR CONSTRUCTION OR PLACEMENT OF ANY COMMERCIAL STRUCTURES IN A CERTAIN AREA OF WARD 4, DISTRICT 5, AS ESTABLISHED BY ORDINANCE C.S. NO. 04-0818, ADOPTED JANUARY 15, 2004

        
    WHEREAS, the Parish Council adopted Ordinance C.S. No. 04-0818 imposing an additional six (6) month moratorium on rezoning and/or issuance of building permits for any commercial structures in a certain area of Ward 4, District 5; and

    WHEREAS, to protect and preserve the health, safety and property interests of residents, it is necessary to extend the moratorium on commercial development in said area to allow sufficient time for parish staff and citizen review of existing land use in the area and make appropriate recommendations to the Parish Council.

    THE PARISH OF ST. TAMMANY HEREBY ORDAINS that it extends for an additional six (6) months the moratorium on the receipt of submissions by the Parish Zoning and Planning Commissions for the rezoning of property and/or the issuance of building permits for construction or placement of any commercial structures in that area of Ward 4, District 5 described as follows:

        1 1.      The east side of 3rd Street on that portion north of Sharp Road.
        2 2.      The north side of Sharp Road west from the centerline of Highway 59 to its intersection with 3rd Street.
        3 3.      The south side of Sharp Road west from the centerline of Highway 59 to its intersection with an unnamed right-of-way forming the western boundary of Century Oaks Subdivision.

    BE IT FURTHER ORDAINED that this Ordinance shall be effective immediately upon final adoption and remain in effect through December 3, 2004.

    BE IT FURTHER ORDAINED that the moratorium herein imposed may be vacated, in whole or in part, by Resolution of this governing body pursuant to Chapter 5, Article II, Section 5-056.00 of the Parish Code of Ordinances.    

    REPEAL: All Ordinances or parts of Ordinances in conflict herewith are hereby repealed.

    SEVERABILITY: If any provision of this Ordinance shall be held to be invalid, such invalidity shall not affect other provisions herein which can be given effect without the invalid provision and to this end the provisions of this Ordinance are hereby declared to be severable.
