    ORDINANCE TO EXTEND FOR AN ADDITIONAL SIX (6) MONTHS THE MORATORIUM ON THE ISSUANCE OF PERMITS FOR THE CONSTRUCTION OR PLACEMENT OF BUILDING STRUCTURES ON CERTAIN PROPERTY WITHIN UNINCORPORATED ST. TAMMANY PARISH ABUTTING A PORTION OF LOUISIANA HIGHWAY 22, MANDEVILLE, LOUISIANA. (WARD 4, DISTRICT 4)

    WHEREAS, the Parish Council adopted Ordinance C.S. No. 03-0757 imposing an initial six-month moratorium on construction or placement of building structures on property abutting a certain portion of Highway 22 in Ward 4, District 4; and

    WHEREAS, the purpose of the moratorium was to allow sufficient time for evaluation and improvement of drainage conditions in the area covered by said moratorium; and

    WHEREAS, additional time is needed to complete data and formulate measures to protect and preserve the health, safety and property interests of residents living within said area.

    THE PARISH OF ST. TAMMANY HEREBY ORDAINS that it extends for an additional six (6) months the moratorium on the issuance of permits for the construction or placement of building structures on certain property within unincorporated St. Tammany Parish abutting a portion of Highway 22 in Ward 4, District 4, described as follows:

    All property within unincorporated St. Tammany Parish which abuts, in whole or in part, that portion of Louisiana State Highway 22, which extends from its intersection with U.S. Highway 190 North to an imaginary line across Highway 22 immediately before the entrance to Fairview Riverside State Park, as more fully described on the map attached hereto.

    REPEAL: All Ordinances or parts of Ordinances in conflict herewith are hereby repealed.

    SEVERABILITY: If any provision of this Ordinance shall be held to be invalid, such invalidity shall not affect other provisions herein which can be given effect without the invalid provision and to this end the provisions of this Ordinance are hereby declared to be severable.

    DATE OF ENACTMENT: This Ordinance shall become effective immediately upon final adoption.
