         ORDINANCE TO TEMPORARILY CLOSE WOODVINE
        STREET FOR AN INDEFINITE PERIOD OF TIME, LOCATED
        IN DE VAL ESTATES SUBDIVISION, NORTH OF
        MANDEVILLE, LOUISIANA, WARD 4, DISTRICT 5

     WHEREAS, the petitioner, who owns property abutting the aforementioned Parish street right-of-way, has petitioned the St. Tammany Parish Council to temporarily close Woodvine Street for an indefinite period of time located in De Val Estates Subdivision, north of Mandeville, Louisiana; and

    WHEREAS, the petitioner owns the lots abutting the street in question and further is requesting permission to place a fence with a gate on said street; and

    WHEREAS, the reason for the request is to prohibit individuals from accessing the street and trespassing and causing damage to the petitioner's property; and

    WHEREAS, the Departments of Public Works, Engineering, and Planning have reviewed and researched said request and have reported their findings to the St. Tammany Parish Planning Commission; and

    WHEREAS, the St. Tammany Parish Planning Commission, upon review of said petition, and after having considered all of the facts relevant to this request, has concluded that the request to temporarily close Woodvine Street for an indefinite period of time is justified, and therefore recommends to the Parish Council the adoption of the proposed street closure.

    THE PARISH OF ST. TAMMANY HEREBY ORDAINS, that the Parish Council concurs with the findings of the Planning Commission and therefore grants approval of the street closure for a portion of Pointer Lane subject to the following:

1.    The street shall be closed for an indefinite period of time and can be reconsidered for reopening at any time hereafter at the request of the petitioner or his heirs or assigns.

2.    The fence and gate shall be aesthetically pleasing and properly constructed and maintained and shall be set far enough back off of the intersection with LA Highway 59 as not to cause a traffic and safety concern.

3.    The fence and gate shall be maintained by the petitioner at his own expense.

4.    The street shall be maintained at least to the current construction standards.

5.    St. Tammany Parish reserves the right to access the street, if necessary.

    REPEAL:
All ordinances or parts of Ordinances in conflict herewith are hereby and henceforth repealed.

    SEVERABILITY: If any provision of this Ordinance is held to be invalid, such invalidity shall not affect other provisions herein which can be given effect without the invalid provisions, and to this end the provisions of this Ordinance are hereby declared to be severable.

    EFFECTIVE DATE: This Ordinance shall become effective fifteen (15) days after adoption.
